OWN.TN is a registered business in Australia and supports Australian Consumer Law. Our agreement sets out the standard terms and conditions on which we supply our Services to customers.
1. You may make an Application to receive Services in one of the following ways:
a. By completing and submitting an order form on our website;
b. By completing and returning paperwork that we have provided to you;
2. We will assess your Application based on a number of factors, including but not limited to the following criteria:
a. A fraud check, where we pay request a photo of your credit/debit card showing the last 4 digits with name visible to confirm you are the card owner when you have paid via Stripe;
b. The accuracy of the information provided by you during order;
3. You must pay all invoices by the due date. Unless otherwise agreed in writing, the due date is noted on your invoice;
a. If an invoice is not paid by the due date, you agree that we may suspend your service within 72 hours, and terminated within 5 days;
4. We aim to provide 99.5% uptime, but do not guarantee, continuous and fault-free services. You acknowledge and agree that:
a. We must carry out regular maintenance on our Network in order to continue to provide the Services, which is outside of the uptime target;
b. We will try to carry out maintenance outside of normal business hours, but there may be circumstances where this isn't reasonably possible; and;
c. In case your service is available for less than 99.5% where the event is within our control, compensation shall be paid out as an additional day of service for the day it is unavailable;
5. You may not use, or facilitate or allow others to use, the Services:
In case of violation of the above, your server shall be suspended.
OWN.TN respects your right to privacy and is committed to safeguarding the privacy of our customers and website visitors. We adhere to the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). Personal information during the ordering process is only collected for billing purposes and fraud prevention. All personal data are storely securely and remains confidental.
6. Network connectivity disclaimer
a. For our Kazkahstan location, we provide an unrestricted symmetrical 1Gbps connection that is available at any time and committed with the ISP. Note that the connection is shared among customers on the same hypervisor and may be lower. We are unable to guarantee you can achieve the full 1Gbps to a destination as this is based on many factors.
b. For our Uruguay location, we provide up to 600Mbps burst during off-peak period (8AM-8PM GMT -3) and 200Mbps burst during peak period (8PM-8AM GMT -3). The burst is best effort based on usage among customers on the same hypervisor. The burst is best utilised for short durations. A symmetrical (dedicated) 100Mbps connection speed is available at all times and committed with the ISP. We are unable to guarantee you can achieve the full 600Mbps to a destination as this is based on many factors.
